These Terms and Conditions (“Terms”) govern your use of the PocketBuy website and, where applicable, your purchase of products from PocketBuy vending machines, smart vending units and micro-market services.

By using our website, contacting us through it, or purchasing from a PocketBuy-operated machine, you agree to these Terms to the extent they apply to you.

Nothing in these Terms affects any mandatory rights you have under applicable consumer law, including rights under the Consumer Rights Act 2022 and other laws that cannot lawfully be excluded or restricted.

The website and services are operated by PocketBuy Limited trading as PocketBuy.

You may use our website for lawful purposes only. You must not misuse the website or attempt to interfere with its security, availability or operation; use automated means to scrape, harvest or extract data without our written permission; upload or transmit malicious code, spam or unlawful material; impersonate another person or organisation; or use the website in a way that infringes our rights or the rights of others.

We may suspend, restrict or terminate access to the website where reasonably necessary to protect our systems, users, rights or business interests.

We try to ensure that information on our website is accurate and up to date, but content is provided for general information only. It does not constitute legal, financial, nutritional, medical or professional advice, and should not be relied on as such.

Images, product examples, machine visuals, site illustrations, case studies and service descriptions on the website are illustrative unless we expressly state otherwise.

Any enquiry, brochure, pitch deck, proposal, discussion, site review or indication of interest provided through or after use of the website is not a binding commitment by PocketBuy to install equipment, enter into a placement arrangement, supply any particular products, or provide services at any location unless and until a separate written agreement is signed by us.

We may refuse, pause or withdraw from any proposed installation, partnership or supply arrangement where commercially, technically, operationally, legally or safety-wise appropriate.

Where you purchase products from a PocketBuy-operated machine:
• all sales are subject to product availability;
• prices shown at the machine or checkout interface are the prices payable at the time of purchase;
• products, brands, package sizes and pricing may change from time to time;
• we may set limits on availability or purchase quantities where reasonably necessary; and
• a completed transaction is formed when payment is successfully authorised and the product is dispensed, or, where a vend fails, when the issue is later resolved in accordance with these Terms and applicable law.

Where applicable, displayed prices may include the Irish Deposit Return Scheme deposit for eligible containers. At present, the scheme deposit is €0.15 for eligible containers from 150ml to 500ml and €0.25 for eligible containers above 500ml up to 3 litres.

You are responsible for returning eligible empty containers to an authorised return point to recover any deposit, subject to scheme rules.

PocketBuy machines are generally cashless unless expressly stated otherwise. Payments may be processed by third-party payment service providers.

We may decline, reverse, refuse or place temporary holds on transactions where reasonably necessary for fraud prevention, payment verification, technical failure handling, legal compliance, manifest pricing error correction, chargeback management, or system integrity.

We are not responsible for delays or failures caused by third-party payment networks, banks, mobile wallet providers or telecommunications providers outside our reasonable control.

If you are charged and a product is not dispensed, the wrong product is dispensed, or a product is materially defective, please contact us using the machine contact details, support details or website contact details and include, where possible, the machine ID, date, approximate time and transaction information.

We will investigate and, where appropriate under our legal obligations and internal checks, provide a refund, replacement or other remedy.

Nothing in this section limits your statutory rights as a consumer.

Customers should always check the product packaging before consumption for ingredients, allergens, nutritional information, usage instructions, warnings, age guidance and any other mandatory information.

If you have allergies, intolerances, medical conditions, dietary restrictions or product-sensitivity concerns, do not rely solely on shelf position, website imagery, brand familiarity or assumptions based on previous stock. Always read the on-pack information before use.

We may remove, substitute, restrict, withdraw or recall products where required for safety, legal or operational reasons.

We do not guarantee that every machine, product line, website function or support channel will be available at all times.

Availability may be affected by maintenance and cleaning; stock shortages; power, connectivity or payment network issues; vandalism, damage or site-access restrictions; host-location opening hours, policies or closures; and events outside our reasonable control.

You must not misuse our machines or services. This includes attempting to tamper with, damage, force, bypass, reverse-engineer, obstruct, defraud or interfere with any machine, payment flow, software, anti-theft mechanism, sensor or service process.

We reserve the right to cancel transactions, refuse service, block abusive activity, recover losses, and refer suspected unlawful behaviour to relevant authorities.

Unless otherwise stated, all intellectual property rights in the website and our branding, logos, text, graphics, designs, photos, videos, layouts and marketing materials are owned by us or licensed to us.

You may view and print website content for your own lawful informational use only. You may not copy, reproduce, modify, distribute, republish, frame or exploit website content for commercial purposes without our prior written consent.

Our website may contain links to third-party websites, products or services. These links are provided for convenience only. We do not control and are not responsible for the content, availability, terms, privacy practices or performance of any third-party website or service.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any statutory consumer rights or remedies that apply by law.

Subject to the paragraph above, and to the fullest extent permitted by law:
• we are not liable for indirect, incidental, special or consequential loss;
• we are not liable for losses arising from misuse, vandalism, unauthorised interference, failure to follow on-pack instructions, or use contrary to warnings or common sense;
• we are not liable for service interruptions, stock unavailability or delay caused by matters outside our reasonable control;
• for business users only, we exclude liability for loss of profit, loss of revenue, loss of opportunity, loss of goodwill and indirect business interruption loss.

Where liability cannot be excluded but can be limited, our liability will be limited to the amount paid by you for the relevant product or transaction, except where a greater remedy is required by law.

If you use the website or our services on behalf of a business, you agree to indemnify and hold us harmless against losses, claims, liabilities, costs and expenses arising from your breach of these Terms, misuse of the website, unlawful conduct, or infringement of third-party rights, except to the extent caused by our own breach of law or contract.

We are not responsible for any delay or failure to perform caused by events outside our reasonable control, including power outages, internet or telecom failures, strikes, civil disturbance, vandalism, governmental action, epidemics, severe weather, fire, flood, supply disruption or similar events.

We may update these Terms from time to time for legal, regulatory, commercial, operational or security reasons.

Any updated Terms will be posted on this website with a revised “Last updated” date and will apply prospectively from that date unless a different effective date is stated.

These Terms are governed by the laws of Ireland.

If you are acting as a consumer, nothing in these Terms deprives you of mandatory protections or rights available under the law applicable in your place of residence where those protections apply. Any dispute may be brought before any court of competent jurisdiction as permitted by applicable law.

If you are acting in the course of business, the courts of Ireland shall have non-exclusive jurisdiction over disputes arising out of or in connection with these Terms.
